The leave may not have been applied in the system, the leave balance may already have been zero, or the approval may not have reached payroll before salaries were processed. This article covers what\u2019s legal, what isn\u2019t, and what you can do if you think your salary was deducted incorrectly.<\/span><\/p>\n<h2><b>What the Law Actually Says<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><b>Code on Wages, 2019<\/b><span style=\"font-weight: 400;\"> which replaced multiple older labour laws and applies to all employees in India allows employers to deduct salary for: absence from duty, damage or loss caused by the employee, recovery of advances, and a few other specific categories.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8216;Absence from duty&#8217; is the relevant one here. It means working days you weren&#8217;t present <\/span><i><span style=\"font-weight: 400;\">and<\/span><\/i><span style=\"font-weight: 400;\"> had no paid leave entitlement to cover. The law calls this Loss of Pay (LOP). Switching from 26 to 30 mid-year without notice is not acceptable.<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">Example: you earn \u20b940,000\/month. Company uses 26 as divisor. You have 2 days of LOP. Deduction = (\u20b940,000 \u00f7 26) \u00d7 2 = \u20b91,538 \u00d7 2 = \u20b93,077.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">The deduction must appear on your payslip as a named line item &#8216;LOP 2 days \u20b93,077&#8217; not buried in &#8216;other deductions.&#8217; Under Form V of the Code on Wages 2019, every deduction has to be itemised. If you can&#8217;t see what was deducted and why on your payslip, that&#8217;s a compliance problem on the employer&#8217;s side.<\/span><\/p>\n<h2><b>Deductions That Are NOT Legal<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">There are deductions employers cannot make, regardless of what the company policy says:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Deducting for days you were on approved paid leave.<\/b><span style=\"font-weight: 400;\"> If the leave was sanctioned and balance existed, the deduction is wrongful. The approval record is your proof.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Deducting salary as a fine for behavioural reasons without following proper process.<\/b><span style=\"font-weight: 400;\"> The Code on Wages allows fine-based deductions only for acts specified in a registered list approved by the appropriate authority with a ceiling of 3% of wages in any wage period. Random &#8216;fines&#8217; for late arrivals or minor rule violations beyond this are not legal.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Deducting more than what was actually lost.<\/b><span style=\"font-weight: 400;\"> If you missed one day, the deduction is one day&#8217;s wage. Not two. Not a &#8216;double deduction&#8217; as penalty.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Deducting salary during authorised holidays or weekly offs.<\/b><span style=\"font-weight: 400;\"> If you were absent on a day the office was closed anyway, there&#8217;s no basis for an LOP deduction.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Withholding earned salary entirely.<\/b><span style=\"font-weight: 400;\"> Even if there&#8217;s a dispute notice period, outstanding dues, equipment not returned your employer cannot withhold salary already earned. The Code on Wages requires timely payment of wages. Withholding salary pending a dispute is itself a violation.<\/span><\/li>\n<\/ul>\n<h2><b>What About Sick Leave and Medical Emergencies?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">If you were sick and had sick leave balance, the days should be covered as paid leave no deduction. But here&#8217;s where it breaks down in practice: the sick leave has to actually be applied and approved in the system, not just communicated verbally to a manager.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A lot of employees say &#8216;I told my manager I was sick&#8217; and a lot of managers say &#8216;yes but it wasn&#8217;t applied in the system.&#8217; Payroll runs on what&#8217;s in the system, not on what was said in a call. If you were sick for 3 days, apply for sick leave properly. If you&#8217;re genuinely bedridden and can&#8217;t, ask a family member to email or message HR get something documented. The WhatsApp message to the manager is not a leave application.<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">If sick leave was applied late due to a genuine emergency, you can ask HR to process a reversal where the LOP is cancelled and the amount credited in next month&#8217;s salary. This is at HR&#8217;s discretion, usually requires a medical certificate. It does happen, especially for first-time situations. Worth asking.<\/span><\/i><\/p>\n<h2><b>What to Do If You Think the Deduction Is Wrong<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">First, check the actual facts before raising a complaint:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Check your leave balance on the date of the absence was there balance to cover it?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Check if the leave was actually applied in the system not just communicated to a manager<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Check if the leave was approved an applied-but-not-approved leave defaults to LOP in most systems<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Check the payslip is the LOP amount calculated correctly based on your salary and the company&#8217;s stated divisor?<\/span><\/li>\n<\/ul>\n<p><b>If the deduction is genuinely wrong<\/b><span style=\"font-weight: 400;\"> leave was approved, balance existed, calculation is off raise it in writing to HR. Email, not WhatsApp. &#8216;On [date] I took 2 days of casual leave. The leave was approved by [manager] on [date]. My balance at the time was [X] days. The payslip shows an LOP deduction of \u20b9[amount]. Please review and reverse.&#8217; Keep it factual, attach the approval if you have it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If HR doesn&#8217;t respond or declines to reverse a clearly wrongful deduction, the next step is a written complaint to the Labour Commissioner in your state. This is a formal process but the bar for what constitutes a wage violation is fairly clear under the Code on Wages a wrongful LOP deduction on an approved leave is textbook.<\/span><\/p>\n<h2><b>For Employers Avoiding the Dispute<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The most common reason LOP disputes happen in Indian companies isn\u2019t usually that someone deliberately made the wrong deduction. It\u2019s that <\/span><b>leave, attendance, and payroll are being managed in different places<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An employee applies for leave on WhatsApp, the manager approves it, HR notes it somewhere, and payroll is calculated from a completely different attendance sheet. Somewhere along the way, that approved leave gets missed.
